§ 1 Scope of application, contractual partners
(1) These General Terms and Conditions apply to all contracts that a consumer (§ 13 BGB) or entrepreneur (§ 14 BGB) concludes with HighEnd Computer GmbH, Oskar-Klumpp-Str. 16, 72135 Dettenhausen, email: info@he-computer.de (hereinafter referred to as “we”/“us”) via our online shop.
(2) We only recognize deviating terms and conditions of the customer if we have expressly agreed to their validity.
§ 2 Information on the ordering process (e-commerce obligations)
(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
(2) Before submitting your order, you can check and correct your entries using the technical means provided in the shop (e.g., shopping cart/input fields, back functions).
(3) The order steps and essential contract information (goods, prices, delivery costs) are displayed on the order overview page.
(4) We store the contract text. We will send you the order data and terms and conditions by email; previous orders can be accessed there if you have a customer account.
(5) The contract language is German.
§ 3 Conclusion of contract (“button solution”)
(1) By clicking on the “Place order” button, you are submitting a binding offer.
(2) We can accept your offer within 5 working days by
a) expressly confirming the order by email or
b) shipping the goods.
(3) An automated confirmation of receipt merely documents the receipt of the order and does not constitute acceptance.
§ 4 Prices, shipping costs, payment methods
(1) All prices are quoted in euros including statutory VAT. Plus applicable shipping costs, which are shown during the ordering process.
(2) Payment methods: Prepayment/bank transfer, PayPal, purchase on account (only after prior individual agreement; subject to successful credit check; payment term 7 days net from invoice date; electronic invoicing).
(3) No additional fees for SEPA transfers/direct debits or payment cards. In the case of cash on delivery, delivery companies may charge their own fees.
(4) Pricing errors: In the event of obvious typing/calculation errors, we reserve the right to contest/withdraw; we will refund any payments already made immediately.
§ 5 Delivery, delivery area, delivery time
(1) We deliver within Germany and to the EU countries listed on our “Shipping & Delivery” page.
(2) Custom PCs (customer-specific designs): The production and testing time is 5–10 business days from acceptance of the order. Shipping then takes place. Express only speeds up transport from dispatch; the production and testing time remains unaffected.
(3) Components/accessories (in stock): Shipping usually takes place on the next business day after receipt of payment.
(4) Transport time after shipment and shipping costs can be found on the “Shipping & Delivery” page; the information is also displayed in the checkout before the order is placed.
(5) Partial deliveries are permitted if reasonable; we will bear any additional costs incurred as a result.
(6) Shipping method (parcel/freight forwarder): Depending on the item, delivery will be made as a parcel or by freight forwarder (mini pallet). The shipping method specified for each item during the ordering process also applies to return shipping in the event of cancellation.
§ 6 Retention of title Until full payment has been made, the goods remain our property.
§ 7 Transfer of risk / shipping risk
(1) Consumers (B2C): The risk of accidental loss/deterioration is only transferred to you upon delivery.
(2) Businesses (B2B): In the case of mail order purchases, the risk is transferred to the buyer as soon as we hand over the goods to the carrier.
§ 8 Digital Elements & Software Updates (new)
(1) Whether a product contains digital elements (e.g., firmware/UEFI, preinstalled operating system) can be determined from the information provided at checkout immediately before placing the order (under “Digital Elements & Updates”) and, if available, from the respective product page.
(2) Goods with digital elements: We provide the functional and security updates necessary for contractual compliance and inform you of their availability during the period required by law. The technical provision of updates is usually carried out by the respective manufacturer (e.g., via auto-update functions and system notifications). Please keep auto-updates enabled and install updates promptly.

(3) Separately purchased software (e.g., Windows, Microsoft Office, Acronis): Updates and upgrades are provided by the manufacturer/licensor</strong]; please refer to their instructions.
(4) Failure to install necessary updates may affect the contractual conformity of the goods and limit our handling of warranty claims to the functions affected by this.
§ 9 Warranty (rights in respect of defects)
(1) The statutory liability for defects applies.
(2) Consumers: limitation period 2 years from delivery; for used goods, it can be reduced to 1 year – only with express, separate agreement prior to conclusion of the contract. Within the first 12 months, the legal presumption applies that a defect already existed at the time of delivery.
(3) Entrepreneurs: Limitation period 1 year from delivery; this does not apply to claims for injury to life, limb, or health, in cases of intent/gross negligence, in cases of fraudulent intent, or under the Product Liability Act.
(4) Notice periods: An obligation to report “obvious defects” within a short period of time only applies in pure B2B transactions; it does not apply to consumers.
§ 10 Liability
(1) We shall be liable without limitation in cases of intent and gross negligence, for damages resulting from injury to life, limb, or health, in accordance with the Product Liability Act, and in cases where a guarantee has been assumed.
(2) In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations (cardinal obligations) and then only to the extent of the foreseeable, typical damage. Otherwise, liability is excluded.
§ 11 Returns / RMA (organizational) Returns under warranty or revocation can be registered via our customer support (RMA). Upon request, we will organize a pickup by a shipping company (mini pallet); the return shipping costs are based on § 18. Legal rights exist regardless of a prior RMA assignment.
§ 12 Consumer right of withdrawal (reference)
For consumers, the cancellation policy in § 18 applies; the sample cancellation form can be found in § 19. Important for custom-built PCs: See § 17 (no right of withdrawal for custom-built products).
§ 13 Information in accordance with the German Battery Act (BattG) & Electrical and Electronic Equipment Act (WEEE)
(1) Batteries/rechargeable batteries: End users are legally obliged to collect and return used batteries separately; the crossed-out wheelie bin symbol means that batteries do not belong in household waste. They can be returned free of charge to us or to municipal collection points. For mail order, information must be included in the shop and/or the shipment.
(2) ElektroG/WEEE: We draw attention to the options for returning old devices and to the meaning of the WEEE symbol. Where applicable, distribution is only carried out with valid WEEE registration; customers are required to delete personal data from old devices before returning them. (Further information is available in the shop.)
§ 14 Consumer dispute resolution (§§ 36, 37 VSBG)
We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board. Irrespective of this, we will provide information in accordance with § 37 VSBG once a specific dispute has arisen.
§ 15 Data protection
Information on the processing of personal data can be found in our privacy policy (separate page in the shop). Information on social plugins (e.g., Facebook Like button): Use—if at all—only with prior consent and in compliance with joint responsibility with the provider.
§ 16 Applicable law, place of jurisdiction, final provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with their habitual residence in the EU, the mandatory consumer protection provisions of their country of residence continue to apply.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes is our registered office.
(3) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.

§ 17 Custom PCs (customer-specific products)
(1) Definition. “Custom-built PCs” are non-prefabricated goods that are manufactured according to the customer's individual specifications (e.g., selection of specific CPU/GPU/RAM/SSD/case/cooling/OC profiles) and are therefore clearly tailored to the customer's personal needs.
(2) No right of withdrawal. There is no right of withdrawal for custom PCs. This is expressly stated in the cancellation policy (§ 18 “Exclusion of the right of withdrawal”).
(3) Start of production. After accepting the order, we begin procuring the specific components and assembling the PC. Subsequent changes/cancellations are only possible as a gesture of goodwill and, if necessary, for a flat fee, provided that procurement/assembly has already begun.
(4) Delimitation. This provision does not apply to standardized stock PCs, standard configurations without individual customization, and accessories/peripherals that are not individually manufactured.
(5) Rights in respect of defects unaffected. Statutory rights in respect of defects (warranty) and any warranty claims remain unaffected by this provision.
§ 18 Cancellation policy (for consumers)
Note: There is no right of cancellation for custom-built PCs (customer-specific products); see § 17.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day
– on which you or a third party named by you, who is not the carrier, took possession of the goods, or
– if you ordered several goods as part of a single order that are delivered separately: on which you took possession of the last goods, or
– if goods are delivered in several partial shipments or pieces: on the day you took possession of the last partial shipment or the last piece.
To exercise your right of withdrawal, you must inform us (HighEnd Computer GmbH, Oskar-Klumpp-Str. 16, 72135 Dettenhausen, info@he-computer.de) of your decision to withdraw from this contract by means of a clear statement (e.g. letter or email). You can use the sample withdrawal form for this purpose, but this is not mandatory.
To meet the deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the expiry of the withdrawal period.
Consequences of revocation
If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us) without delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.
Return shipping costs:
You are responsible for the direct costs of returning the goods.
– Goods that can be shipped by parcel service (e.g., components/accessories) can be returned as an insured parcel (costs: customer).
– PC systems that cannot be shipped as parcels (return shipment by freight forwarder/mini pallet) incur the following return shipping costs: up to €79.00 per system within Germany, up to €99.00 to Austria/Benelux, up to €149.00 to the rest of the EU. On request, we can arrange for collection via our logistics partner. Please use the original inner padding/transport securing devices (e.g., GPU support/Instapak) or equivalent protective packaging.
You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for the purpose of checking their condition, properties, and functionality.
